sounds like something is wrong with the parking brake mechanism. Does it feel like they are always applied?

E-brake or possibly the pistons are not retracting after pressure is applied. When was the last time the system was bled? What year is the car? Have the calipers ever been replaced? Repaired? Damaged?

x2 - I think the B5 is a cable actuated e-brake. Check around the rear wheels for the cable and housing.  It should be black and it goes into the area where your caliper is.  If it's been cold it could have gotten wet and frozen, or it could just be corroded or bound up on something.

The car is a 98 and the calipers have never been replaced. Ive been told that the caliper might not be retracting. so if thats the case it would need new calipers??

NO - don't fall for the "you need new calipers" pitch.  They are fine, but probably just need to be serviced and lubed - new pins/guides/bushings.  Good time to turn the rotors and replace pads.

As Mike mentioned the calipers should be serviceable. The rotors on the Passat are marginal to begin with, so if they can't be turned don't be shocked. They aren't terribly expensive to replace, you could source the parts from parts4vws.com and maybe save a few bucks and DIY.

Like gietl said parts4vws.com or ecstuning.com - they both have the parts and I have always had good luck with them.
